This week, special counsel Jack Smith dropped a 165-page filing, which lays out the evidence he would present in a January 6 criminal case against Donald Trump.
There’s a lot of new evidence. For example, an aide hoped Trump would do something to help Mike Pence, after the Vice President escaped the Senate chamber and ran to a secure location. Instead, Trump said, “So what?”
Throughout the filing, Trump receives dispositive evidence that he lost the election — from his campaign team and Bill Barr to state and local Republican officeholders who all told him the numbers weren’t there.
Still, Trump persisted — while watching Fox News coverage for hours and as the mob brutally attacked the Capitol Police — until he finally called for the rioters to go home. And told them that he loved them.
The case against Trump is there. Judge Chutkan will first rule whether or not the evidence involves Trump’s official duties, for which he cannot be prosecuted according to the Supreme Court immunity ruling. It does not.
The circuit court will make the next determination, and then it goes back to SCOTUS, which will make the same determination. Only then will Trump be prosecuted.
And here’s the kicker, only if Trump loses. Now you know why I am writing this email.
This election is the closest one our country has had in a century. Most of the polling averages for the seven battleground states are within about a one-point margin. It’s time to get out there and work. And/or donate.
